Inktober Day 10: Pattern

this one was gonna be a doozy no matter what bc its so difficult for me to draw repetitive/consistent things without suffering a horrible fit of boredom, which is a real problem if youre into comics?? so i might as well make it simple and cute

So, I've only done some cursory research on it so far, but I think I have a reasonable idea of what's going on.

For those out of the loop, the term "Inktober" has been trademarked, and artists using the term are getting Cease and Desist letters. Now, C&Ds aren't legally enforcable on their own - they're more of a scare tactic. However, IF it evolves into lawsuits, they can be used to establish an intent and establish that previous attempts at a resolution had been established.

Before I go any further, I want to look at this tweet.

This tweet is, in fact, to use one of the kinder applicable terms for it, bullshit. For starters, lawyers don't just go off and autonomously do stuff like this. Reason the first being that trademarks are expensive. When we were looking at a trademark, to get a lawyer to do it properly, it cost us $1,500. A lawyer would not just go on their merry way and do that without clearing it with their client first. Second, let's have a look at the actual trademark filing itself. Since this is blowing up now I imagine it was a recent fi- oh. Oh no.

It doesn't show great on screens, sorry about that. But lets look at the pertinent dates.

Filing Date: November 3rd, 2017. That means this was filed over two years ago. I find it EXTREMELY unlikely that a lawyer kept someone in the dark about an expensive process for two years.

Published for opposition July 17th 2018 - that's normal, iit takes a bit of time for the paperwork to go through. Registration date October 2nd 2018 would be the day it went live. In other words, this guy is saying he had no idea he had a trademark for over two years. I feel it's infinitely more likely that this is a reaction to folks finding out about it, and the C&Ds are being done because enough time has now passed that a reasonable assumption that the perceived infringement is "willful", rather than the brand historically being community-led and open-source kinda.

So, my overall take is pretty much along the lines of "not cool, dude". Going forward, Waterfall won't support Inktober, and will instead support "Drawtober", a hashtag coined by other artsits - I'm not sure whether KikiDoodleTweet on Twitter actually coined the term or not but we'll be looking into that before we go live with this October's contest so we can make sure we're crediting the right folks.

All the same prizes and rewards for participating stand, but yeah we're not gonna support that kind of behaviour.

Quick edit to add - our lawyer is on the cheap end, and costs $400 an hour. C&Ds, even copy pasted, are probably gonna be around that much for 4 because billable hours and stuff. Even if this isn't about the trademark, and it just about the C&Ds - it still wouldn't be something that they do autonomously.

it was so hard to fill in all those floorboards but so worth it bc it looks gorgeous. i love how this one turned out exactly how i imagined it. like it exists now. in the real world. wow
